Brexit and The EU Settlement Scheme

As part of the conditions surrounding the EU settlement Scheme and the current ‘grace period’ individuals who are considered ‘frontier workers’ can continue to apply for a Frontier Worker permit until 30 June 2021. The permit allows EU/EEA/Swiss citizens to enter the UK to work whilst their primary residence is elsewhere.

Individuals may be eligible if all the following apply:

  • you’re from the EU, Switzerland, Norway, Iceland or Liechtenstein
  • you live outside of the UK
  • you worked in the UK by 31 December 2020
  • you have kept working in the UK at least once every 12 months since you started working here

There are no fees to apply for the permit and individuals do not have to pay the immigration health surcharge although, payment may be required to submit the biometric information (photograph or fingerprints).

For further information on the grace period and EU Settlement Scheme, please see the Gov.ukguidance leaflet, Right to Work calculator and to apply to the Settlement scheme see EU Settlement Scheme.

Continuous Qualifying Period of Residence

Please note there is currently an emerging theme across the sector that colleagues who remain outside of the UK due to the Pandemic may impact their ‘continuous qualifying period of residence’ for applications in respect of settled/pre-settled status or to transfer from pre-settled to settled status. For government guidance on continuous qualifying periods of residence see: here.
